Terms, Privacy & Refunds
Last updated: September 25, 2026
This page covers everything you need to know about using Ship & Scale: the terms for our products and services, how we handle your data, and how refunds work. We've tried to keep it in plain English. If anything here is unclear, email lucas@shipandscale.dev.
Ship & Scale is operated by Lucas Casa de Vito, based in São Paulo, Brazil. On this page, “we,” “us,” and “our” mean Ship & Scale and Lucas Casa de Vito. “You” means the person or company using our website, products, or services.
Terms of Service
By using shipandscale.dev, buying any of our products, or booking a build, you agree to these terms. If you don't agree, please don't use the site or our services.
1.1 What we offer
- Starter Kit: a SaaS codebase you can use to build your own products.
- Founder Playbook: a written guide on building, launching, and growing a SaaS.
- Founder Community: a Discord community for founders using Ship & Scale.
- The 15-Day Build + Marketing System: a done-for-you service where we build your SaaS MVP and deliver a custom marketing plan for your first users.
1.2 Starter Kit license
When you buy the Starter Kit, you get a personal, non-transferable license to:
- Use the code to build and run as many of your own products as you like, for yourself or for clients.
- Modify the code however you want.
You may not:
- Resell, redistribute, or share the Starter Kit itself, in whole or in part, as a template, boilerplate, starter kit, or similar product.
- Publish the source code in a public repository or share your access with people who haven't bought it.
Products you build with the kit are yours. The restriction only applies to reselling or sharing the kit itself.
1.3 Founder Playbook and content
The playbook and any related content are for your personal use. You may not copy, republish, or resell it. You're welcome to quote short parts with a link back to shipandscale.dev.
1.4 Founder Community
The community is a place for founders to help each other. Be respectful, don't spam or hard-sell other members, and don't share anything illegal or harmful. We can remove anyone from the community who breaks these rules, without a refund of any product purchase, since community access is a bonus rather than a paid product on its own.
1.5 The 15-Day Build + Marketing System
Scope. Every build starts with a build call and a written spec. The spec defines exactly what we'll build. Anything not in the approved spec is out of scope and can be quoted separately or added to a later phase.
Timeline. The 15 days start when you approve the spec and pay the deposit. The timeline pauses while we're waiting on you for feedback, content, access, or decisions. To keep things on track, we ask that you reply within one business day during the build.
Your responsibilities. You agree to provide the information, feedback, and account access we need (for example Vercel, Supabase, Stripe, domain, and GitHub accounts in your name), and to make sure anything you give us (text, images, logos, data) is yours to use.
Deadline guarantee. If your product isn't live by day 15 and the delay is on our side, we'll keep working at no extra cost until it is. This guarantee doesn't apply to delays caused by slow feedback, scope changes, or third-party services outside our control.
Payment. The price is $2,500 USD, paid in two parts: 50% to start and 50% on launch day. The final payment is due when the product is live and ready for handover.
Ownership. Your code lives in your own GitHub account from day one. Full ownership of the code and all intellectual property we create for your project transfers to you once the final payment is made. We keep the right to reuse general techniques, know-how, and any parts of the Starter Kit your product is built on, and you receive a Starter Kit license (section 1.2) for those parts.
Portfolio. Unless you ask us not to, we may mention your product in our portfolio after launch. We'll never share confidential details, and we're happy to sign an NDA whenever you want one.
Support. You get 30 days of support after launch. Support covers fixing anything we built that doesn't work as described in the spec, and answering questions while you get running. It doesn't cover new features, changes to the spec, or issues caused by changes you or someone else made to the code. Ongoing work after that can be arranged through a separate agreement.
Marketing system. The marketing system is a custom plan that you carry out yourself. It's based on our experience, but we can't guarantee specific results like signups, revenue, or customer numbers, since those depend on your market, your product, and how you run the plan.
1.6 Third-party services
Our products and your build rely on third-party services such as Vercel, Supabase, Stripe, Resend, GitHub, OpenAI, and Anthropic. Your use of those services is governed by their own terms and pricing, and you're responsible for any costs on accounts in your name. We're not responsible for outages, price changes, or policy changes made by those providers.
1.7 No guarantees of results
We work hard to give you useful products and a solid build, but we can't promise any particular business outcome. Our products and services are provided “as is,” to the extent allowed by law.
1.8 Limitation of liability
To the fullest extent allowed by law, our total liability for any claim related to our products or services is limited to the amount you paid us for the product or service the claim relates to. We aren't liable for indirect or consequential losses, such as lost profits, lost data, or business interruption.
1.9 Changes to these terms
We may update these terms from time to time. When we do, we'll change the “Last updated” date at the top of this page. Changes don't affect builds that are already in progress, which continue under the terms in place when you paid your deposit.
1.10 Governing law
These terms are governed by the laws of Brazil. Any dispute will be handled by the courts of São Paulo, Brazil, unless the consumer protection laws of your country give you the right to bring a claim where you live.
Privacy Policy
We collect as little data as we need to run Ship & Scale, and we never sell it.
2.1 What we collect
- Contact and booking details: your name, email, and anything you share when you book a build call, message us on WhatsApp, or email us.
- Purchase details: your name, email, billing country, and what you bought. Payments are processed by Stripe, and we never see or store your full card details.
- Project information: anything you share with us during a build, such as your idea, specs, content, and account access.
- Technical data: information needed to operate the site, such as browser and device details. We do not currently use a separate website analytics tool.
- Community data: if you join our Discord, Discord handles your account data under its own privacy policy.
2.2 How we use it
- To deliver what you bought, including code access, playbook access, and your build.
- To reply to your messages and run your build call.
- To send you important updates about your purchase or build.
- To send occasional product updates, only if you opted in. You can unsubscribe at any time.
- To improve our website and products.
2.3 Who we share it with
We only share your data with services that help us run Ship & Scale, and only what they need:
- Stripe for payments
- Resend for emails
- Vercel and Supabase for hosting and data storage
- Cal.com for booking calls
- GitHub for code access
- WhatsApp if you choose to message us there
We may also share data if the law requires it. We never sell your data or share it for advertising.
2.4 Confidentiality of your project
Anything you share about your product or business during a build call or build is treated as confidential. We don't share it with anyone outside the people working on your project, and we're happy to sign an NDA if you want one in writing.
2.5 How long we keep it
We keep your data for as long as you're a customer or as long as we need it to meet legal, tax, and accounting requirements. You can ask us to delete your data at any time, and we'll do so unless we're legally required to keep it.
2.6 Your rights
Depending on where you live (including under the GDPR in Europe and the LGPD in Brazil), you have the right to:
- Access the data we hold about you
- Correct anything that's wrong
- Ask us to delete your data
- Object to or limit how we use it
- Get a copy of your data in a portable format
- Withdraw consent for marketing emails at any time
To use any of these rights, email lucas@shipandscale.dev. We'll reply within 30 days.
2.7 Cookies
We use cookies needed for the site to work, including sign-in, checkout, and your saved interface preferences. We do not currently use advertising cookies.
2.8 International transfers
We're based in Brazil and some of our providers are in the United States and other countries, so your data may be processed outside your home country. We only use providers that offer appropriate protections for your data.
Refund Policy
3.1 The 15-Day Build + Marketing System
- Before the spec: if you change your mind after paying the deposit but before we send your spec, you get a full refund of your deposit.
- Don't like the spec: if you're not happy with the spec we send, let us know before you approve it and you'll get a full refund of your deposit. No questions asked.
- After you approve the spec: once you approve the spec, the build starts and the deposit is no longer refundable, to the extent allowed by law, since we're putting real time into your product.
- Final payment: the second 50% is due on launch day. If we miss the deadline because of a delay on our side, we keep working at no extra cost until your product is live (see section 1.5).
3.2 Starter Kit and Founder Playbook
You can request a full refund within 7 days of purchase, no questions asked. The Starter Kit and Founder Playbook are sold together as the Founding Edition, so a full refund ends access to the bundle. If something doesn't work as described, email us and we'll fix it or make it right. This policy does not limit rights you may have under applicable law.
3.3 How to request a refund
Email lucas@shipandscale.dev with your name, the email you used to pay, and what you'd like refunded. Approved refunds go back to your original payment method. The time they take to appear depends on your bank or payment provider.
